Claims of Copyright Infringement - Digital Millenium Copyright Act (DMCA) § 512
Xome Inc. and its subsidiaries (Xome CT LLC, Xome PR LLC, and Xome OH LLC) (collectively, "Xome") respect and value the intellectual property rights of others and need to ensure that everyone using Xome's services does the same. Xome complies with the notice-and-takedown procedures set out in Section 512(c) of the Digital Millenium Copyright Act ("DMCA"), 17 U.S.C. § 512(c), which applies to content reported and removed for violating copyright rights in the United States.
If you believe that your work has been reproduced on the Xome website, the Xome app, or any other Xome service in a way that constitutes copyright infringement under the U.S. Copyright Act, 17 U.S.C. §§ 101 et seq., please send written notification to Xome's registered copyright agent and provide the following information in accordance with the process set out in Section 512(c) of the DMCA:

Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

Identification of the content that you claim is infringing or the subject of infringing activity and that needs to be removed or access to which needs to be disabled, and information reasonably sufficient to permit Xome to locate the content;

Information reasonably sufficient to permit Xome to contact you, including your address, telephone number, and, if available, an email address at which you may be contacted;

A signed (physical or electronic signature) statement that you have a good faith belief that use of the content in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

A signed (physical or electronic signature) statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon Xome's receipt of a valid written notification, Xome will act expeditiously to remove, or disable access to, the allegedly infringing content.
If your content is removed under the DMCA, and you believe that the content was wrongly removed because of a mistake or misidentification, you may submit a counter-notification to our registered copyright agent. Please send your written counter-notification to Xome's registered copyright agent and provide the following information in accordance with the process set out in Section 512(g) of the DMCA:

Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or access to it was disabled;

A signed (physical or electronic signature) statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content to be removed or disabled; and

Your name, address, and telephone number, and a signed (physical or electronic signature) statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located or, if your address is outside of the United States, for any judicial district in which Xome may be found, and that you will accept service of process from the person who provided notification under Section 512(c)(1)(C) of the DMCA or an agent of such person.
Upon Xome's receipt of a valid written counter-notification, Xome will forward the counter-notification to the party that reported the allegedly infringing content. The forwarded information will include your contact information.
